Plaintiff Candi Wigginton, a civilian employee of the United States Army, filed a complaint alleging that three of her civilian co- employees, one of whom was her supervisor, had committed the torts of assault, intentional infliction of emotional distress, and sexual harassment. Plaintiffs complaint demanded compensatory and punitive damages. At the close of plaintiffs case, the trial Judge dismissed the intentional infliction of emotional distress claim as to all defendants and the assault claim against defendant Nicholas Servidio. At the close of all the evidence, the Judge dismissed the assault claim against defendant Glenn Perlakowski. Plaintiff then voluntarily withdrew her assault claim against defendant Gerardo Martinez. Plaintiff also successfully moved to amend her pleadings to allege a sexual harassment claim under the New Jersey Law Against Discrimination, N.J.S.A. 10:5-1 to -42 ("LAD"), including a claim for attorneys fees and costs, in substitution for her original claim of sexual harassment.
