The first time this case was before us, we reversed the United States District Court for the Western District of Texas and found that Carl Edwin Wiggins had been impermissibly denied his Sixth Amendment right to represent himself in a Texas robbery trial and ordered that a writ of habeas corpus issue pursuant to 28 U.S.C. Section 2254. See Wiggins v. Estelle, 681 F.2d 266 (5th Cir. 1982). After having been reversed on this point by the United States Supreme Court in McKaskle v. Wiggins, 465 U.S. 168, 104 S. Ct. 944, 79 L. Ed. 2d 122 (1984), we initially affirmed the decision of the district court without a further hearing. 729 F.2d 1026. On Wigginss motion, we have reconsidered that decision and held a hearing on the remaining issues in Wigginss petition. For the reasons stated below, we again affirm.
